Welcome to ZenPay. These Terms of Service ("Terms") govern your use of the ZenPay payment gateway services, website, and any related applications (collectively referred to as the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
ZenPay reserves the right to modify these Terms at any time. We will provide notice of any material changes through the Service or by other means. Your continued use of the Service after such modifications constitutes your acceptance of the modified Terms.
To use the Service, you must be at least 18 years old and capable of forming a binding contract with ZenPay. If you are using the Service on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

To access certain features of the Service, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify ZenPay immediately of any unauthorized access or use of your account.
ZenPay provides payment processing services that allow merchants to accept payments from their customers. By using our payment processing services, you agree to the following:
ZenPay charges fees for the use of its payment processing services. These fees are detailed in our Pricing page or in a separate agreement with you. We reserve the right to modify our fees with reasonable notice to you.
You authorize ZenPay to deduct applicable fees from the payment amounts before transferring funds to your designated account. You are responsible for any taxes or duties associated with your use of the Service.

The Service, including all content, features, and functionality, is owned by ZenPay and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and disclose information about you. By using the Service, you agree to the collection, use, and disclosure of your information as described in our Privacy Policy.
To the maximum extent permitted by law, ZenPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, or business opportunities, regardless of the theory of liability.
Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you have paid to ZenPay in the six months preceding the claim.
You agree to indemnify, defend, and hold harmless ZenPay and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service.
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the Canadian Arbitration Association, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
